Querist : Anonymous (Querist) 11 January 2023 This query is : Resolved
Respected Experts,
Can a single party register power of attorney to sell land in a different state in India?
or the power of attorney holder is required to be present at the registrar's office where at the time of POA is being Registered.
kavksatyanarayana (Expert) 11 January 2023
The Principal (who is giving Power to a person) must attend the Sub Registrar Office concerned but not the Agent(who is the POA holder). After registration of the POA in other states, the POA shall be got be validated where the property is situated.

What are the facts? What is the context?

It is no longer permissible to transfer property through PoA except in specified cases. Please see Supreme Court decision Suraj Lamp & Industries (P) ... vs State Of Haryana & Anr.
