Power of attorney given by a lady partner

RESPECTED SIR/MADAM.
I HAVE JUST ENTERED INTO A PARTNERSHIP AGREEMENT TO RUN PARTNERSHIP BUSINESS. ONE OF THE PARTNER IS WOMEN, SHE WISHES TO GIVE HER POWER OF SIGNING CHEQUES/OPERATING BANK ACCOUNT TO HER SON BY EXECUTING GENERAL POWER OF ATTORNEY. IS IT NECESSARY TO REGISTER THE GENERAL POWER OF ATTORNEY. AND WHERE TO REGISTER AND WHAT IS THE FEE. KINDLY ELABORATE.I AM BASED IN GHATKOPAR - MUMBAI-MAHARASHTRA

registartion is must if partner wants the power of attorney holder to transfer immoveable property on her behalf . toherwise it is advisable to get it properly stamped and notarised .

if you so desire you can have it regsitered .

registering the power of attorney can be done in two ways. one is registering it with the Notary that he/she deponent has signed the POA before the notary. and if you involvement is about the transactions between the parties and involves a big/large amounts then its better to register the partnership firm and along with it the POA for operative account holder who is authoritative {POA holder} to operate the account on your behalf.

Registration of a POA, if not involving transfer of immovable property, is not necessary. Notarisation of GPOA is a must. In Mumbai the stamp duty for GPOA (Not involving immovable property) is only Rs.100/-. You have to affix the photos of both the person giving the power and the agent. PAN numbers of both also should be mentioned agaisnt the signatures.
