Summons / notices has been issued to six respondents by the civil court to appear before the court on the date fixed. My query is that do all the six respondents who have received the summons / notice have to sign the power of attorney / vakalanama / authority letter and give to advocate on their behalf to appear.

Yes you've to sign POA or Vakalatnamma and give it to your counsel to file in court.

Refer the Orders of Bench of High Court of Kerela comprising of Honorable Justice V.Chitambaresh and Justice K. Ramakrishnan in the Case of Brenda Barbara Francis VS Adrian Mirand Case it has ruled that " An Advocate can not plead and argue a case as a Power of Attorney Holder on behalf of the Parties ".

In case two respondents not willing to given their power of attorney /vakalatnama / authority letter to another respondent to appear on their behalf what results will happen.

They would be treated as Ex Parte if they do not appear... Since the majority of Four are co operative it will not affect the Case.

Also note the Vakalatnama could be given only to the Advocate.

The Power of Attorney could be given to any one of the Respondent Side.If the Power of Attorney is given to any other person apart from the case it would have limitations.

If all parties agree to sign PoA in anyone's favor out of them they may do so..... If they are unwilling it is their choice..

If the unwilling parties want to appear as PIP or not appear let them do so……….. The parries that are willing may sign the vakalathnama for the counsel engaged by them.. The parties that appear before court do not contempt the court…

Vakalanam / authority letter to be given to advocate to appear on their behalf. In case two respondents given power to attorney to one respondent do he have to file the power of attorney of the respondents before the court.
