Dear exprts,
A person filed a case aganist a bank for recovery of Tracter who forcibly seized the vehicle thouh there is difficiency of service regarding the tractor alleging that default of instalments.then who is the competent authority to contest the case in the court of law on behalf the bank.The person filed the case aganist a branch where the loan is availed.my question is whether the branch manager has to contest or any other person has contest on behalf of the bank.is not require power of authority given by the BOARD of directors through a resolution to contest on behalf of the bank.kindly advice.

Are you putting this query on behalf of the bank? If so you ask Legal Dept of your controlling office (RO/ZO)

Any authorised officer of bank can represent he bank for which no POA is required.

The authorised person of Bank can repersent the Bank and there is no need of POA.
