Problem facing in two banks regarding aadhar and pan link

Hello My mother getting pension of my father since 25 years , father had expired and served for the army as a havaldar rank.. Now at that time my grand father furnished the nick name of my mother in the army records for pension as “poonam devi”. My mother was also on state government job as a primary school teacher and retired few years back in 2008 where her name is kala devi as per her educational certificates and records...Now these days aadhar and pan requirement is compulsory for every bank account opened. And now she is facing the problem that i am describing .... first these are details of two bank account where one bank is connected to my father pension and other is connected to my mother pension (as she retired form teacher few years back)
SBI Bank : My Father Pension (or My mother Husband Pension)
Mother name (written on passbook): poonam devi
Bithdate: 08/09/1950
&
PNB Bank: Mother pension
Mother Name (written on passbook): Kala devi
Bithdate: 08/09/1950
(Both the Bank account is opened in the same city)
Even few years back at 2011 i had made court affidavit regarding this that both the name is of same person which was nototrized and duly signed and stamped by city SDM (State District Magistrate) Also an Advertisement was also published on local newspaper so that in future no problem would arrive (I have all the documents including affidavit and newspaper advertisement kept safely) then on the basis of this affidavit and documents AADHAR CARD name which was formerly “kala devi” was corrected Now n Aadhar the new corrected name is “ Kala Devi alias Poonam Devi”. But i have not changed it on Pan number in which only Kala Devi is written as per her educational records As people told me that you can’t change the name in pan like Alias Name. It should be only one name.. My mother teacher pension is well connected to Pan card and also Income Tax written is filled on time but now because in Sbi bank there is a need of pan and aadhar to be connect but when i furnished all the details to Sbi bacnk they are denying to accept and saying that your aadhar can not be linked to our system because there it showing error as in passbook or bank details it is poonam devi and in aadhar the name is in alias (which is Kala devi alias poonam devi) and also said that in the Pan card your mother name not matches to our Bank records....Problem is what to do in this type of situation Some says do this Some says do that but no one even the bank employe have the correct answer...SBI Bank employe says change all names according to the Pension of My father as it is very complicated to change the Army records and a very lengthy process but if i do that then what about my mother own teacher pension? Because sooner or later this condition would also arise at other bank of pnb..Now what to Do?
My mother is very depressed as she is thinking that in few Days May be her Husband Pension Would Stopped.

In earlier thread you said that it was your grandmother who gave wrong name.

The whole query seems to be a misstatement. Either you are unaware of the facts or yourself want to get wrong advise based on wrong facts.

You grandfather or grandmother was nobody (just nobody) who would give the name of widow to Army. In armed forces whenever some PBOR reports from leave after marriage he is summoned in unit office to complete documents and is called upon to change nomination.

SO name Poonam Devi would have been entered by your father only and you which may have been name of his wife.

There can be hardly anyone (who knows that 2+2=4) to believe that such name could be a nickname. This is a proper name of a lady existing in reality which your mother knew and claimed pension on her name.

Your mother was Kala Devi a Govt employee and while being in govt service she had been drawing pension in wrong name of “Poonam Devi”.

Had she been caught doing so while in service she could have lost her job.


Still liable for a criminal case.

Actually she would have continued getting pension of someone else using wrong name had the RBI not launched strict drive against fraudulently opened benami account

Many such persons have been caught in this drive.

She can no more draw pension from that account. If the issue is raked up then she can face FIR as well.

SO let her coolly contend with her lawful pension she is getting from state govt.

Given facts indicate a very strong possibility that that :

1. The soldier died.
2. He had a wife called Pooname Devi.
3. He registered his with Poonam Devi.
4. Later he married Kala Devi.
5. For fear of losing job in Army he never reported this marriage to Army.
6. He died.
7. Kala Devi posed as Pooname Devi and claimed pension.
8. She oped account in the name of Poonam Devi.
9. Unsuspectingly the CDA continued remitting pension in the account.
10. Unsuspecting the bank continued paying the pension.
11. Due to Adhar linking of bank account her cover is blown and now she is not able to operate this account.

2008 में पूरे 60 वर्ष कि आयु में रिटायर हुई अम्मा को कहो कि पुलिस का सामना करने के लिए 70 वर्ष की उम्र काफी ज्यादा होती है खासकर उसके लिए तो कभी थाने न गया हो (अभियुक्त कि तरह)

I differ with the view of Shri Sudhir Kumar, which states "THE FACT IS THAT. She can no more draw pension from that account. If the issue is raked up then she can face FIR as well. SO let her coolly contend with her lawful pension she is getting from state govt."

A pertinent question arises, why she should not draw her due pensions and on account of what offense an FIR would be lodged against her?

If she is a legally wedded wife and her name was changed by her husband or in-laws, she cannot legally be denied the family pension of her deceased husband. If she herself was employed with her original name in the Government organization, she cannot also be denied her own pension.

Earlier, the name of a woman used to be changed by in-laws after marriage. So, there can be two names of a woman, the pre-marriage and the post marriage names. The problem arose only due to the requirement of compulsory linkage of the Aadhaar No. with the PAN Card as well as the Bank Account, as only an Aadhar Card with a single name can be issued with a unique biometric system of the human body of a person. Stoppage of pension can be due to non-linkage of Aadhar with the Bank account, but legally none of the two pensions, if due, can be denied to the pensioner.

So, some frantic effort may be required to be made to bring the serious lacuna to the notice of the Supreme Court of India, the PMO, and the UIDAI with adequate proof of the names of the woman to seek some legal solution from these institutions. The iron is still hot as the matter is under active consideration of the Supreme Court of India and nobody would so far have pointed out such a very serious problem. The querist may better hire some prudent lawyer to represent the issue appropriately before the authorities concerned.

In fact, any type of pension should not be made liable to be linked with the Aadhar Card. Adequate solution is required to be sought rather than forgetting to draw any one of the pensions.

Since you have stated in the following thread that you are a politician, you may better get your problem solved through political channels, as only the politics is the only root cause of your problem. Linking of Aadhar has not been prescribed by any of the experts of LCI, it is only by the desires of the present day political party in power.

If against my, opinion, can you please clarify on which point you disagree with me? Mind it, as against your allegation, I have not opened your 7 years old post. In that respect, you are grossly mistaken. So far I know, I have neither advised you wrongly 7 years before, nor in your present thread.

However, your post smacks of some intention of blackmailing tactics by keeping yourself hidden in the veil of anonymity to highlight our opinions as wrong through the media. ALSO, if you feel that my opinion can be proved wrong at any time in future, may be 10, 20 or even 50 years with reference to the present day rules of the Government, you may keep that post duly framed, so that the same may not be destroyed or lost from your record.

@dhingra1962....sir my words was not for you even you are the only person who guided and support me with a better explanation...the words that was written was for another man...Also i am not making politics here I am here to know whether the the case that I have finished belong to some other? Because if somebody have faced this unique problem then I am sure he also tried some process through which he got success...and the lawyers may be got or faced this type of problem regarding pension of his clients...that's the only reason to write in Lawyers Club...I am very appreciated to you and thanks for guidance to me ...you are my elder and I respect you...Because sudhir jee directly attacked and wrote something bad about my mom that's why I used that language in his way of talking...by the way dhingra sir those wrong words was not for you...thanks.

actually this person will never accept that 2+2=4.

He came here wot listen to some views which are suitable to his ears. He doe snot seem to be interested in knowing the evidence that his father has created against his mother.

He does not seem to believe that the exercise involves amendment of PPO by changing official record to alter name of wife of soldier that too after so many years.

he does not seem to understand that none is going to believe that just because his grandfather/grandmother gave a statement and name of mother was recorded wrongly.

He doe snot seem to ready believe that a soldier has to submit a nomination form giving details of the nominee and whatever name he stated then in his life time that cannot be altered at the request of third party.

In another thread someone advised him to represent to NPS. He was apparently happy without understanding that the case is not of NPS [meant for post 1.1.2004 appointed civilians only].

So finally I have advised him the details of correct authority whom he should represent. Let him represent and if not successful go to AFT. If not successful then go to Supreme Court. May be he is able to prevail upon the Supreme Court to frame new directions to be applied to all future Family Pension Account.
