(Querist) 21 September 2010 This query is : Resolved
Hi,

If i have retained only a power of attorney for a particular property. Then can i make an agreement to sell that property with another person.
Rajeev kulshreshtha (Expert) 21 September 2010
If the power of attorney gives you the power to make agreement or sell the property you can make an agreement to sell with another person otherwise not.

I agree with Mr.Rajeev Kulshreshtha.

Yes first one has to see the contents of the POA. The power vested through POA can only decide whether sell it or not.
pawan sharma (Expert) 21 September 2010
yes you can.
Chanchal Nag Chowdhury (Expert) 21 September 2010
First & foremost the POA must give U the power to sell the property. Secondly & equally important is that the POA must be Registered POA.
Uma parameswaran (Expert) 21 September 2010
Read the conditions and rights in the POA and if it allows you can.
Devajyoti Barman (Expert) 21 September 2010
Yes you can.

verify following things.
are u family member or co-owner?if not
then it should be backed with some agreement with consideration paid fully or partly with specific power of to do so.it is good to register to prove its genuinity ,but some s.s.c. case laws says it is not necessary. .
yogesh (Expert) 22 September 2010
You can make the agreeement if there is clause in the POA
