Procedure for probate

(Querist) 20 February 2013 This query is : Resolved
Can anyone guide me the detail process of obtaining probate of a WILL. Do the oposing party gets a copy of a WILL before they submit their say?
Advocate M.Bhadra (Expert) 20 February 2013
You can file a probate case in District Court or District Delegate Court for granting of WILL.For the filing process you have to submit the original WILL in the Court and serve a copy to the opposite party. If the opposite party have consent in favour of beneficiaries then file a consent petition on behalf of them, otherwise the case have to be filed on contest as Original Suit. You should better to contact with a Civil Lawyer.
Raj Kumar Makkad (Expert) 20 February 2013
There is no separate procedure in probate cases except that a specific court deals this issue and original will is required to be produced on the court file before saying of opposite party.
Devajyoti Barman (Expert) 20 February 2013
The opposite can inspect the Will but can not get a copy of Will.
