I m staff nurse working in a central govt hospital in Bangalore. As per our promotion policy , first promotion eligibility is regular service as a staff nurse in that institution. But currently after 15-17 yrs of regular service only first promotion is getting. The reasoning giving for this delay is no vacancy in higher post. Apart from nurses , no other employees promotion is delayed for this much long duration. I would like to know your opinion in this regard, can it consider as an injustice towards nurses, because honourable CJI on January,2014 mentioned that promotion is a fundamental right of an employee based on article 14 of constitution of India

NB: first promotion eligibility is 2 year regular service as a staff nurse in that institution

MR. Shyju, you seem to be a sacrificing staff nurse, as you sacrificed a pretty long period of 15 years of your service !
By the way, what for you preferred to stick to the post without promotion for 15 years long even after being eligible after 2 years of your qualifying service?

Thank you Jigyasu sir for your valuable opinion. I have only 7 yrs regular service, but the situation is bit different. Institution giving regular financial progression as per govt order, and also provides an incharge post after 12 or 13 yrs, but which is administrative role/post only and designation will be staff nurse only. So that most of the collegues are considered it as a promotion, because of promotion delay recruitment also not happening . How to tackle this situation.

Such situation may arise in certain institution/post. The Government has already formulated a scheme of ACP/MACP to take care of the situation and avoid stagnation.

The policy of Assured Career Progression (2 promotions after 12 years and 24 years) superseded by Minimum Assured Career Progression (minimum 3 promotions after 10,20 and 30 years service) is applicable in government sector.
Consult a local prudent lawyer practicing service matters.
