Q)my father got self- earned house of my grandfather through family settlement done between all legal heirs of my grand father.my grandfather died without making any will.settlement deed /partion deed is duly registered.my queries are as under-
1)does this house is ancestral/self acquired for my father?
2)can my son claim on this house?
3)if my father does not give any thing to me even than can my son claims any right over it?
4) i have two married sisters also
The main reason of putting this queries is that my wife and son are seprated from me and my wife and her family are in impression that after my son attains 18 yrs he can claim on that house bcos it is ancestral property of his grandfather directly

First of all will is not compulsory to be executed, property canbe inherited by all heir as per respective personal law.
but good that partition deed is duly registered. so there exist no dispute among the one stage of heir and does not make any difference whether property is self acquired or ancestral.
My suggeston whether propery is self acquired or ancestral for father, shall not go ito this by the grandson.
very clearly, this is self ancestral property for grandson & he always can claim that.
Point no. 3 answer also YES.

Q) what are the chances that he can get share in this property? If i am not wrong you want to say when property is divided irrespective of its nature self or ancestral it does not remain ancestral

It appears that you are not getting free legal aid (which is available to those who are prima facie innocent). It also appears that you are unable to afford an advocate and still go to the extent of calling you minor son as greedy, questioning the judge’s wisdom in calling for the evidence, questioning the correctness of paltry sum of rs 5800 given as maintenance, want the advise if she can appeal against an order favourable to you. All this indicates what? Somewhere you may be wrong for having caused this situation. Average Indian women do no like to go to thana against husband unless compelled.
