(Querist) 16 May 2013 This query is : Resolved 
we had 50 acres ancestral property. My father equally divided these property 10 acre per person among 3 bother, mother and self.Now Father and mother given in share to elder brother and they also registered their property in the name of elder brother,
My question is can we claim our share in father and mother property by law.

why do you say it is ancestral ? does it belong to your forefathers?

if your parents have executed gift deed in favour of your elder brother and document is duly stamped and registered your brother would be owner of said property . parents can bequeath their share to whom soever they desire .

when coparceners divided their property with mutual consent then the property shall be regarded as self acquired and thereafter every person is free to deal with it as per his sweet will and whims which has been done in case of your parents.

First you make it clear how did your father got the 50 acres property. Has he owned by his self earnings or got it through forefathers.
