Sir, I had filed RCR in Family Court & on later date my wife filed DV case in SDJM Court. Still both the cases are pending in respective courts. We have 2 kids and staying with me. But my wife is not interested to return to our home. Hope she is getting ill advice from our neighbours. My question is that.
My parents fear that if the court orders for property separation then what to do. They are thinking to transfer the ancestral property to a Trust where they will be members. so that my wife/court cant demand/order for property partition. Is it possible? Or is there any way to save the ancestral property.

1. Need your identification to remove the tag of "anonymous" as you have concealed it.
2. You have already engaged a lawyer to contest the cases on your behalf who is fully aware about the facts and circumstances of the cases and applicability of law; you must have faith in his/her ability, integrity, sincerity and loyalty, otherwise change him/her immediately.
3. Do not adventure to seek second opinion despite the fact it is FREE OF COST, you will spoil your case(s).

Dear Vashista Sir I have faith on my lawer. But experience & knowledge differs from person to person. Since I am in trouble I am trying to get opinion to safeguard myself which I also shares with my lawer. Everyone does this not that I am asking on this platform since it is free of cost. I will be glad if you can put some light on this matter & I shall be obliged for this.

Property can be attached that is belonging to the husband. In your case you are claiming it is ancestral property and your share if she wants can seek for attachment if you do not discharge your liability as ordered by the court. Hence you may consult legal expert on property matters in your area to have the right advise after perusal of papers.
