No one can stop anyone from moving Court. In your case you are advised to state the fact of sale of your mother's agricultural land and sale proceeds appropriated by your eldest brother for his exclusive benefit, in the WILL to be made by your mother as reason for not bequeathing your eldest brother in the willed property. This will make the WILL sound and it would be difficult on the part of your eldest brother to challenge the WILL.
