Property dispute

Hello,

I'm from Bangalore, My father is having a property in Tumkur. Recently we come to know its been forged and registered to a third party. But we have taken the position of the plot & made fencing around it. Initially there was some objections from third party not now. My concern is, since there is no dispute from third party, we have not taken any action / lodged any complaint on forgery. Will there be any issue if the forged registration is not cancelled. Please suggest.

Title of immivable property never transfer without legal document, however, you may take benifit of long peacefull and uninterupted possession i.e adverse possession depends upon facts circustances & evidence.

First be sure of forgery.
Since you have original title deed, you have nothing to worry.

However you can think of selling it to avoid any dispute in future.

You have title papers of the property including possession.

If you want to retain get four walls constructed including one small residential unit.

Better sell out the property.

If you are sure of finding an entry of the alleged encumbrance in the form of alleged forged registration in the encumbrance certificate, obtain a certified copy, consult a local lawyer and file a suit for cancellation or nullifying the said fraudulent encumbrance(registration) or else this encumbrance will continue to disturb you even if you go for selling the property to a third person despite having valid title deeds in your favor.
