Property document lost only xerox available

Hi,

My mother has only xerox of the property documents and stamp duty is not paid or registered. My father had bought this property and lost the original document, now he is no more. How do i go about getting original document and registering.

Discuss and seek the guidance of local good Advocate as there are lot of procedures involved like Police Complaint about lost documents , News Paper advertisement mentioning the same, obtaining up to date Encumbrance Certificate from Registrar for 35 years, Filing a suit in concerned Court regarding lost documents and assisting the court to Call the concerned Registrar for confirmation of lost documents and after all this court would endorse the copy of documents with its Seal and then on wards the Court Endorsed Documents would be treated as Originals

Dear queriest, check the xerox of the document. If you find the date of execution of the document and the details of vendor and buyer, you can apply for certified copy of the document at Registrar office concerned by paying necessary fee. or you can obtain the certified copy through mee-seva centre or online. the certified copy will be treated as original.

You have stated two different and contradicting situations wherein if the documents are
(a) Unregistered and stamp duty "not paid" photocopy are "no" documents which are worst then "Waste papers", that may not be acceptable to rag-pickers and/or kabadi.
(b) if your father had "some" original documents to confirm title of property, which you are stating to have been lost but photocopy is there with your mother it would be advisable to consult a local prudent lawyer with relevant documents for better appreciation, guidance and proceeding.

Yes, with some effort, you can obtain certified copy from the SRO.
