In the year 1988, 43 peoples (unregistred group) have purchased 3.5 acre land in the name of Niyojit Mahavir Ghruh Nirman Sanstha in the name of 5 members.
After that Niyojit society has not been registered uptill now.
Purchase deed is registered in the name of 5 members. In 2007 layout of that land is passed.
In the year 2007, we had given land to 40 peoples.
Remaining 3 peoples have not given development charges.
So we have not given plot to them.
But now they had filed civil suit against 5 members (holder of land).
So please guide for legal position of us. We have not given any single letter, sign, or any other papers to them for their membership.

@Author,how the remaining three (3)people filed the case if they did not pay the charges? however you also file a case against them by consulting a local lawyer.

1. Niyojit Society is non-est.
2. The land belonged to the group of 5 persons, the purchasers.
3. 3 persons(plaintiff) have no locus, if they did not pay the consideration. However, development charges are different to consideration.
4. Show the document/records to a local lawyer, seek his/her professional opinion/ advise and proceed.

On the face of the query, 3 members have little merit in their claim. However, consult local lawyer and show him the case file.
