Property matter

(Querist) 17 July 2012 This query is : Resolved 
I am widow having age 65 years living with two sons both of the son are married and they having their childern. one of my son is notorius. he play gambling. he has lost most of the his money. Now he and his in laws forcing me to sale the property. I never want to sale the property. i am the owner of the property. i have two daughter also.
i want to ask that
(1)i want to disown(bedakhal) the my son from my property. what is the procedure and document required for disown(bedakhal)
(2) my son threaten me. what are the safety/precautionary steps can be done by me to save from him.
(3) My son is living in one of the floor of my house with their family. i want to vacant that floor also.
Please guide me

If it is your exclusive property then in your lifetime your son does not have a share, you can seek to debar him from inheriting your property by way of a registered will. This is how you should proceed :-

1) Give a public notice in the newspaper, seeking to disown your son.

2) File police complaints against your son.

3) File a suit seeking recovery of posession of that house from your son.

All this would further go on to protect you reasonably from a false dowry case that your daughter in law may file.

A lawyer would help you do all the above.

Dear Querist
first of all i want to tell you that if you want to disown your son from your property, it can be possible if the property is your self acquired or you are the absolute owner of the property after sending a written application to DM/Collecter of your area, if you are lived- in any commissioner area you can send an application to the commissioner.after this application you can published a public notice regarding your intention with the detail of this application.
Secondly if your son threaten to you, you can file a criminal complaint against him before the police or court as you think fit.
Thirdly, you can simply send a legal notice to him to vacate the premises within a stipulated time after that if he is not ready to vacate the premises, you can file a suit for vacate the premises or a suit for possession of the property.
