my father had a property( Own Two stories building) in Pune in maharashtra . My father and mother are no more. We are seven legal heirs. With consultation with each other we sold our property to one developer.All legal heirs name were included in 7/12. We all signed agreement and took consideration. All the people in the building vacated their premises.Only one legal hear is not ready to vacate his premises.(He wants extra from developer ) he also signed the agreement . Developer also paid Stamp duty, Registration Charges ect.He also took his share of consideration. Can other heirs take any legal action becouse this is harrasement/Pls advise.

Let the developer take the appropriate action, certainly the other legal heirs will be impleaded as party. And in their Reply to the matter, the LHs may support the case of the developer.

Other legal heir have no locus standi. So wait and watch, for action of developer.

If he has signed the agreement with the developer then legally he is bound to honour the agreement and vacate the premises but if he does not then unfortunately filing civil suit is the only option which I regret is not at all viable option.

Dear Sir,
In our Redevelopment scheme our builder is giving to five legal heirs five flat. Now every body want the flat on main road side and 1st floor or 2nd floor, How will we solved the problem? What builder should take stand.what crateria he should apply.
Please advise.

He can draw lots for fair allocation of flats.
