I have a query for all eminent laywer;s
Can i apply for partition or ask for my share for a property which is owned by my brother,My father was alive when the land deal was agreed upon and just 3to 6 Month after that my father died , and my elder brother who was then the only bread earner and the eldest executed the land deed in his name and now has rejected our claim / share in the above mentioned land which our father had planned to purchase , stateing that the property has been brought by him and not by our father. And his children are entitlled for the same and not any of his siblings

Your brother is correct in legal terms the thus you have no legal remedy, however, such matter should be solved within family.
Devajyoti Barman (Expert) 01 December 2012
You can claim your share through partition but wince the deed is registered in his name and he was a earning member on the family , it would be very difficult for you to succeed in the case.
Mayank Saxena (Expert) 01 December 2012
