dear experts,my wife purchased land in 1991 from GPA holder(registered GPA).the property was purchased on 5 rs indian stamp paper.recently my wife sold the property to third party through registration sale deed.a new complication has arised stating that property is joint property through a court decree divided into equal halves..wife is nt aware of the strangers in the property who are coming for share of the property.what steps shud my wife take to safe guard the property??

What is the court decree and what is the relation of this man with your wife?
Clarify this point first.

Who gave you the GPA?Whether from the decree holder or none other else.In the latter case,the sale deed is not valid.Purchasing on Stamp paper without registered sale deed does not give you marketable title.

answer queries raised by experts . it is your case that wife purchased land in 1991 on Rs 5 stamp papers . sale deed appears to be under stamped . further sale deed not registered . document is in admissible in evidence

A lot of information required, whether sale agreement on Rs. 5/- stamp was registered.
Better consult a local lawyer and show him all the documents.

Buying a property from a GPA holder on Rs. 5 stamp paper itself indicates that the purchase cannot be legally maintainable through court of law as unregistered sale deed is inadmissible in law. Buying a property without ascertaining all the details or obtaining a proper legal opinion is fatal.You may consult a lawyer with all relevant papers and take his opinion on further course of action.
