(Querist) 26 June 2011 This query is : Resolved
sir,
It was three months before,
there is a sale agreement with six months time period to sell the land with building,we got some advance amount from the buying party.now the buying party asking us to give the key of the building, saying that demolish the building and get the flat land and selling to someone else, and settling us the rest of the amount after taking their profit.
they also said that if we don't give them key, ask us return their advance amount.
but we don't interest in the buying party doing so, we want the rest of the amount to be settled before demolish the building.now two more months time period is left as per our sale agreement.
I don't know what should i do,please guide us.

''now two more months time period is left as per our sale agreement.''

wait and watch and as day approaches, serve a notice fixing a date of sale registration cautioning agreement to fail.
never give possession before getting all amount.

Properly advised by Mr Singh, don't handover the possession.
RAJU O.F., (Expert) 27 June 2011
Don't give the key of the building or demolish before sale is complete by receiving the full sale value. If the buyer wanted earlier, insist for payment of the full sale value immediately.
