Property share

Dear Sir/Madam,
I am a resident of CHennai and we are 5 brothers and 2 sisters. Sir my no.2 brother expired in Sept 2012. He is survived by his wife and 6year old son. My late brother owns a house which obviously his wife will get. But the problem is my eldest brother had invested 3 lakhs when they purchased this house and the second brother was paying the loan amount till now. But there is no proof that the eldest brother has paid Rs.3 lakhs other than the no.2 brother who is no more. My eldest brother approached the 2nd bro's wife for his share but she refused asking him to show the proof. Now we dont know what to do. Would like to know how can he get his share. Poor fellow he himself is staying in a rented house and he helped his 2nd bro because other younger brothers are staying with the no.2 bro.
I will be grateful if somehow he can get his share since he has invested that amount. I request to please guide us correctly/legaly.

For a legal claim you should produce some sort of proof of having given Rs. 3 lakhs...

was payment made by cash pr cheque .

If there is no proof of payment of cash then there is no scope to claim share in the property.
