I live in a society where the land belongs to the Trust. But the Co-operative society has also been formed in 1999. At the time of redevelopment Trust has offered the flats on ownership basis. Most of the tenants have accepted this and became the flat owners and are the members of co-opertaive society. There are about 15 out of 72 who did not accept this and remained tenants. Till date they are tenants of the Trust.
Till date 80% of the occupant have not paid the property taxes. The amount is now 1.5 cr. The society members also say that we are not suppose to pay the taxes. The trust will pay the taxes and they are not letting others also to pay.
It been cleary mentioned in the agreement attached that the occupier will have to pay the taxes.
The BMC has sent an aution notice. Please guide who is supposed to pay the property tax in case of owners and tanants.

YOU HAVE SAID THAT
It been clearly mentioned in the agreement attached that the occupier will have to pay the taxes.
Please clarify which agreement is this.

Sir - That is what I am trying to say. Inspite of it is mentioned in the agreement the committee members are misguiding others members that do not pay any taxes. They are referring to some high court judgment and refusing to give us a copy.
This is mentioned in the agreement made between the trust and the society member.

It is presumed that the trust has washed off its hand by handing over the flats for consideration.In such an event,the flat owner is bound to pay the tax,and not the trust.Now you have to decide whether you can abide by the decision to become the owner,or to vacate leaving the fate to the trust.

Sir - The flats are handover to the tenants free of cost without any condisinderation and granted ownership as well with 100 sq. feet extra carpet area.

The case appears to be funny. You earlier informed that
"there are about 15 out of 72 who did not accept this and remained tenants."
Now, you have informed that
"The flats are handover to the tenants free of cost without any condisinderation and granted ownership as well with 100 sq. feet extra carpet area."
What is the reason that 15 tenants did not accept this bonanza.

Sir - They are now leaving in the new flats but they denied onwership becuase they did not want to pay property tax and thought that if they remained tenants forever they will be free from paying property taxes.
