Property tax liability on tenants in redeveloped bldg.

(Querist) 14 July 2013 This query is : Resolved
My friends are tenants of a old building in Andheri-E and are contemplating of accepting the tenancy basis accommodation of equal carpet area in new redeveloped building as the land lords are goons with political and underworld contact and not agreeing to convert tenancy in to ownership as is the practice with good builders.

These goons are insisting on payment of property tax for accommodation in new building in spite of the fact that they shall still be tenants and not the owners.

Pl. help and advice as to how to deal with this situations ?

Dear Siddhi,
You are quite uncharitable when you call the landlords "Goons" especially in the context of your post.
When you are a tenant, how can you expect that you should be treated as a owner? What is the basis for claiming so?
Further, if the electricity charges, water charges, maintenance charges etc., are being charged separately by the landlord apart from rent, so he can also try to collect the property tax from the tenant - otherwise he would be raising the rent (which would include the property tax amount).
Therefore, I do not find that there is anything wrong in the landlord asking for the property tax from the tenant.

dont agree for redevelopment . lodge police complaint against landlord if he is forcing tenants to sign the agreement . generally in case of redevelopment it is true that tenants are given ownership rights as incentive to encourage them to opt for redevelopment . if your room is in a bad shape and needs repairs you have no option but to agree .
