Property will disputes

(Querist) 02 April 2013 This query is : Resolved 
My cousin uncle has no daughter or Son. He has only adopted dughter whom got marriaed now. My cousin anty ( whom name had property) made registered will in the fovour of my wife name. In the will described as adopted son' wife in the favour of my wife.In the registered will my cousion uncle has singned. one my Closer and one my Father has signed in the registered will for Evidences. In the will, My Fife Name , in the place of hasband name - my name and in the name of Place (which register will done and we are living with my cousin Uncle) are mention.Now my Cousin anty has got death.

The above mention Will is registered in registry office.

I have my father's name on my all certificates not that cousin uncle name.
My cousin aunt is no more (Death) so She cannot be make fresh will...

My cousin uncle is alive. has he right to made new registered will in the favour of My wife name ?

has My cousin uncle right to amendment in will as adopted son' wife which was done my Cousion Aunt.

SO OPENED A NEW THREAD.

ANYWAY SINCE YOU have YOUR'S father's name on my all certificates not that cousin uncle name, THE VERY DESCRIPTION OF YOUR WIFE AS ADOPTED SON'SWIFE IS A CASE OF "DOUBT" TO BE EXPLAINED IF WILL IS CONTESTED.

SINCE YOUR AUNT IS DEAD YOUR UNCLE CAN NOT WRITE ANY WILL ABOUT THIS PROPERTY WHICH BELONGED TO YOUR AUNT.

BUT YOUR UNCLE CAN CONTEST THE WILL CLAIMING HIMSELF AND HIS ADOPTED DAUGHTER TO BE HEIR.

PROBATE CAN BE APPLIED IF THERE IS AN EXECUTOR APPOINTED IN THE WILL;
ELSE LETTER OF ADMINISTRATION WOULD BE APPLIED.

ALL DEPENDS ON YOUR UNCLE!WHAT CASE HE SETS UP ABOUT THE WILL.?
