Dear Experts,

Kindly let me know any procedure / formality to be done under Provident Fund Act in respect of those employees whoes joing basic salary is more than rs 6500/= for getting exemption.

Such employees, whose basic pay plus dearness allowance plus food concession, if any is fixed at initial stage of his joining in service Rs. 6500/- or more, do not legally qualify for the grant of benefit of EPF and such employees are Exempted Employees under section 17 of EPF & MP Act 1952 so there is no procedure/formality to force the management to provide such benefit to you. If act is amended then definitely such benefit can be provided to you.

Hi,

While Raj has mentioned the relevant pf F Act, the query as to What exemption is required is also valid.

A person drawing basic salary exceeding 6500/- doesn't itself get blanket exemption to be resolved from PF compliance. He need to give declaration in Form 11, about his earlier membership with PF. If he as earlier a member (and not withdrawn his membership), you need to extend/ continue his membership in PF.

Need to know, what exemption you are talking about. There is a provision under PF Act for granting exemption to employers for excluded employees (i.e. drawing more than 6500/-) so you need to elucidate.
