Namaste,
Myself Swapnil, I stay in Badlapur Thane, Maharashtra. My query is there is a open 2.78 guntha land besides my bunglow. From past 27 years no one is looking on it. I tried to check the owner name online through mahabhulek site through survey number and I found one name in 7/12 of that land. After that I took a print of the 7/12 and enquired the owner contact details in my nearest collector and tehshil office but they dont have any type of contact details in there record.
How can I be able to purchase the land, Can I able to make that land on my name ?
Please guide me for this.

The owner alone can sell.

Yes. the owner can only sell the land. If there are no heirs of the owner, as no one is looking into that, then automatically it will be taken by the Government.

Yeah! Owner alone has power to sell the land. If no legal heirs are there t0o claim rights in the land under the doctrine of exheat Government can takeover the land.

For the purchase of that land I visited the nearest tehshil office to get the contact details of the owner but they dont have any update related to owner contact details in there record book and the area is under NAGARPALIKA so any possibility for the purchase of land at government rate ?

AS the land is under Nagarpalika, generally it will not be sold by Nagarpalika. If you are interested try your best by putting an application to the Commissioner of M.A.D.

What exactly do you mean by :‘contact details of the owner ‘ say phone numbers/email id?

The authority (NAGARPALIKA) alone may have the right to resume the plot in certain circumstances after pursuing specific rules.
Thereafter the authority may auction.

The owners of the plot or legal heirs alone have the right to own (per applicable succession laws) and dispose.
Assuming that owner is Hindu Male: until or unless there is No relative(s) under ClassI,II, Agnates, Cognates…………………………..which can be a long and exhaustive list………………………government may not succeed to own the said plot.

Has anyone in NAGARPALIKA shared with you that you can have the plot @ government rate?
It is believed that government rate is circle/revenue rate for assessing stamp duty and could be much below the prevailing market rate.

The one thing is I dont have my own house, I stay with a family by paying rent to them. I am a BPL card user and not affordable to buy a flat. So I decided to go for the plot nearby my current resident and buy it under government rate by processing loan or under any PMAY schemes. The plot is about 2.78 gunthas and from many years no one has visited on that land. In 1991 the owner of that land had informed my father on there behalf to look after there land and from 1991 they have not yet visited. but recently we are unable to find there contact as no updates available in tehshil record. Some people told me that I can buy the plot at government rate. Directly can I construct a small house on that plot ? Please guide me with proper solution. I am having many hopes for that plot.

The market rate for that plot is ₹९२४०/- प्र. चौ. मि. So what will be the exact amount for 2.78 gunthas ? Please mentioned the exact cost for the plot.
