Purchased a flat but amneties not provided as per the brochure

I have purchased a flat in 2010.As per the brochure given to me by the builder, there were amneties like swimming pool,senior citizen hall and others. But these were not provided by the builder.When we asked he kept promising a future date but nothing happened so far i.e more than a year.It looks like he will not provide and coming to condition that we may be forced to share with the phase II by the builder which was not there as per the agreement signed and the brochure.How do we proceed further?

Complain in Consumer Forum

However Brochure is not a contract. It is invitation to offer, and not a offer.

Sale Deed is Binding, and if it is in SD, u can insist.

as stated by our expert if it is specifically mentioned in the sale deed or agreement of sale or any such MOU then that can be insisted.

Any way, you can file a consumer complaint for unfair trade practice and deficiency in service by the builder, as the builder made false promises to lure you to purchase the flat for a price agreed by you on the basis of those promises.

file complaint for deficency in service for compensation . contact a local lawyer .
