quash 498a in high Court jaipur

(Querist) 01 May 2017 This query is : Resolved 
sir, my wife has filed 498a, 406 against me and my family members. now she is ready for compromise and we have filed divorce by mutual consent.
please suggest whether we should go for quash of fir in 498a or quash of criminal proceedings and what is the difference between this. pl. advice as i am a government employee, and this matter is pending about 10 years. but yet evidence of my wife is not complete.

In fact in such cases nothing could be predicted without going thorough the F.I.R, Charge Sheet, evidences of witnesses and the order Sheet of the Magistrate. However, if you have not been facing any departmental proceedings then it is okay. You can go for compromise or Divorce with mutual consent and have to file a case also to quash the charges under section 498A IPC which are not compoundable. If you are facing departmental proceedings then nothing less than honourable acquittal will come to your help in departmental proceedings.
