Query on defamation

Sir, Need an advise, President and other members in our apartment wants to file a defamation suit against a person for using words like criminal and corrupt in the heading of the letter forwarded to Hon'ble LG of Delhi accusing the members of the society for some reasons. Since the resident used these words in his letter as heading, however the letter does not contain any particular names, however, it was intended for the President, Secretary and the other members of the society. The president and other members of the society wish to file a defamation suit against the resident. How to send a legal notice and what should be contents, any template for the notice would also be advisable.

Since you posted query heading under "Criminal Law". So, In criminal action, no need to sent notice.

In the civil action, you can send notice.

For both matter, you should hire local advocate for it.

yes., if the president decided to proceed as per law mean ask him to consult with his advocate., by his given facts his advocate will draft his notice.,

Sending legal notice for such cases is not mandatory specially the case is for criminal defamation.

YES!no necessity of notice in either side.But in civil cases it is desirable because in defamation cases unconditional apology is treated as defence also .
