what should be the points i have to refer?

Until and unless we have judgment under appeal with pleading, how can one become able to guide you about points? You can consult with some local senior lawyers for this purpose.

1) Section 354 provides for punishment for the offence of Assault or criminal force to woman with intent to outrage her modesty.
2)The section lays down that-‘ Whoever assaults or uses criminal force to any woman, intending to outrage or knowing it to be likely that he will thereby outrage her modesty, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.’
3)it depends upon the facts and circumstances of your case .

The ground of appeal can be decided from the case file and judgement itself.

first of all the appeal is a Q of law. you should find out the Q of law from the judgement and those point which is relevant but not clear out in judgement.

We need to have facts of the case to help you draft points for appeal.....
Raj Kumar Makkad (Expert) 27 November 2011
Jatin! I differ with you. appeal is both a question of law as well as question of fact as this is only first appeal to be filed before district judge.
