A passenger asked for a ticket in the RAILWAY Counter for an Express Train. He was issued a SUPER FAST Train Ticket & charged more money by the counter clerk.
I request Legal Opinion.
(1)Whether the passenger can file a case? Then specify the proper Court of adjudication.
(2)Whether the counter clerk is liable for penalty?
(3)Whether the Railway Administration will be penalised under Vicarious Liability?

1.The passenger can file a case before the Consumer Forum for deficiency of service.
2. The clerk is not personally liable though the Railway is vicariously liable.
3. No question of penalisation , only damage to be granted.
