Recovery agents creating nuisance

my friend is very irritated by the recovery agents of the bank. He has already instructed them and their respective banks not to visit him at home and instead to meet him in his office at the specified timing but yet the recovery agents keep coming to his residence and harass his family members in his absence. Can he ask the society authorities to instruct the Security persons of the society not to let any recovery agent to his flat to meet him ? If the society authorities refuse to accept his written request for not allowing any recovery agents of the bank to his residence, what are the legal remedies available with him to stop these recovery persons from visiting his house? Where to complain against these rogue co-operative Hsg Soc. Authorities , who do not co-operate with him?

Dear Querist
first of all, if there is a loan on him why is he not deposit the payment?
secondly if the recovery agent harass you or your family member you can send a written complaint to Bank/financial institute or banking Ombudsman in Delhi or Mumbai. you can send this application to RBI or you have right to file a civil suit for defamation and a criminal complaint u/s 499/500 of IPC.

1) Tell your friend to pay off his dues. This should be the first step,
2) Send a letter to the Bank asking it to send the recovery agent to your office only under copy to the Ombudsman, Society and police,
3) Lodge a complaint before the police against the harassment of the agents.

Agreeing with experts above i attempt your questions as unde r:-

Ans : Yes.
If the society authorities refuse to accept his written request for not allowing any recovery agents of the bank to his residence, what are the legal remedies available with him to stop these recovery persons from visiting his house?
Ans : Generally societies do not refuse such request of resident. if they do they are abettors of the criminal case which you may file.
Where to complain against these rogue co-operative Hsg Soc. Authorities , who do not co-operate with him?
Ans : Thana. In case any of them is ex-police official then get his details and complaint to IGP for action under Pension Regulations.
