A recovery suit was filed on bases of an agreement.The agreement was signed by two persons as witnesses.Now these two witnesses have been shifted to an unknown place.What will be effect of absence of witnesses on recovery suit?

where is the principle of the agreement, if all the members are not known or heard off, than issue paper publication, if you know their assets than ask to court for attachment.

suit is valid if filed within 3 years of date of agreement.

If witnesses are not available to depose their evidence then any other person can depose identifying the signature of the witnesses. Such person may be from the office of the witness, if he was working when he was in the same city or from any other source.
