i am a propritor of trading co,i supplied materials to a closely held ltd company promoted by gulf based nri,s during the period of 2000-2001 financial year.total directors are 11 members.the company due to me rs 21lacs as on 2001.the company was sold by apsfc to recover their dues,subsequently one of the in charge director given a cheqe for rupees 21lacs from his personal a/c since company bank a/c was not in operation.the said cheque become bounced.i field a case at hyderabad where my jurisdiction falls.
till date i can not surve the arrest warants on 3 directors who is staying at riyad.ineed procedure to surve on them,will the entire bord is liable for punishment.

I look basically the interests of accused in NI 138 cases and so from defense point of view your case is difficult.
However you can file civil suit for recovery. with delay condonation against the new owners.

It seems to be time barred , in civil as well as NI.
need to go in detail & examine your documents/ complaint/ notice u/s 138 to advise you properly.
