refund

what is the time set for refund ? if department not do action than what is the course of action , can any penal intrest may be charged for delays ?

There is no legal time frame set up for the same. However, department published a citizens charter under which refund was promised within 4 months of claim. It seldom happens.

As per provisions of Act, a return needs to be processed within one year from the end of financial year in which return was filed. Hence, ideally one should get refund alongwith intimation u/s 143(1) within that time frame. If the refund is delayed beyond that time, you can first enquire from the ITO or write to the commissioner. If no help comes, use RTI to know the status of your file or file a complaint before the Income Tax Ombudsman.
