I, N.J. Mishra, working as a Legal Officer in a private ltd company, need your help in getting the judgments. Ealrier i was not entertained because my user name reflect as anonymous. I tried to change the same but failed on all the occasions. Actually complaint has been filed before the District Forum by one student asking for refund of fees. The academic year was suppose to start on 04/03/2011, this candidate informed on 25/01/2011 that he is not willing to do his course and want refund of admission fees. this candidate before takinh admission gone through the terms and conditions of the prospectus and agreeing upon the same he took the admission. as per the terms and conditions we refused to return the admission fees. dear member kinldy provide relevant judgements to support my case.

If the student is not willing to join the course, you cannot force him or deny him the refund of the fees.
You said that it is as per the terms and conditions of the prospectus. But, please note that any terms and conditions which are against the public policy & principle of natural justice are illegal in the eyes of law.
At the you can deduct a nominal amount from the fees paid by him as administration expenses.
The said student had informed you well in advance that he is not willilng to join the course.
Thus, it is advisable to settle the matter refunding the amount, otherwise, there is a reisk of getting an order to pay the entire amount along with interest and further compensation for mental agony and harrassment.

Yes I agreed. Mr nadeem here that as such guagge institution can capacity to offer a lawyer to do. We don't know what clouse being made in the norms of admission if any then detect the part of money and pay back the balance

what is the course?there are aicte/ugc guide lines regarding refund of fees.
accordingly,a deduction of rs.1000/-only is permitted,if the student withdraw before the commencement of the course.
also,it is against the law to admit much before the commencement of a course.

Deduction is allowed as per rule, for Adm expense etc.
