Refund of motor vehicles tax

Hello everyone,
section 7(3) of the Karnataka motor Vehicles taxation Act states that "the Registered owner of the vehicles who has paid such tax is entitled to refund'. The RTO contends that it is only the first registered owner of the vehicles who is eligible to refund of road tax even though ownership of the vehicle is transferred to the third person.
By virtue of transfer of ownership of the vehicle, the rights and liabilities of the vehicle stand transferred to the present registered owner of the vehicle. kindly advise on what should be done to get a refund from the RTO.

You misconceived the provision. Read the entire contemplation of law and ask question. No where in the world taxes are refunded " just like that". I read the provision. You too read.

The RTO can take such a stand only if there exists any provision to this effect in the Motor Vehicles Act or Rules made there under or instructions issued by the Competent Authority.
You may obtain the relevant information in this regard under the RTI Act.

Dear Wishwanath,
Please clarify the following points, as your query does not contain any background info for seeking refund of the tax:
1) Whether the vehicle was removed outside Karnataka state? If so the actual date of removal?
2) On the date of removal whether the ownership stood transferred in your name or not?
3) What was the date of registration of the said vehicle in the new state?
4) What was the date on which the concerned registering authority could send an intimation (CRTI) to the original registering authority regarding migration of the Motor Vehicle?
Unless these queries are satisfied, you may not be able to get any purposeful solution to your problem. STRETCHING OF THE THREAD MAY BE OF NO USE MERELY ON ACADEMIC TYPE OF THE QUERY.

The question arises, when you are not able to provide the basic necessary data, background and the present status of the case, how you can expect a solution from the experts merely on the basis of their guess? Example is very much available here in your present query, where you have not given the very basic data based on which refund can be justified.
