Refund of my college fees

Sir,

I was Admitted to a PVT College (Deemeed University)for B.Tech

Within one month, i withdraw from the college
on the ground that i wish to prepare for competitive exam

The college refund my Hostel and mess fees after some deduction.
But it Doesn't Refund my Provisional Admission fees of Rs. 50000/-

I Filled an RTI with UGC asking Abt the Guidelines issued by UGC to Pvt College where a student withdrawns with one month

Is Filling an RTI with UGC is justified ?

I have not received any reply with 30 days,

What should i do ?

You can move an application under the provisions of RTI Act and can seek desired information and thereafter yo can file either consumer complaint or a writ in high court or a complaint to Registrar of University or can initiate all actions at one and same time as cause of action though is same but grievance shall be different with all agencies.

Mr.Amit,

I have asked you what is the break up. I guess it is a academic query.

Normally the educational institutions will say a fee of say Rs.1 lakh, but, the Rs.1 lakh will have a break up as follows:-

Admission fee:- X
Tuition Fee :- Y
Security Deposit :- Z

You can recover y and Z, not X, if you claim refund immediately after the admission but before the commencement of the course.

X is already incurred for admitting you. y, z can be refunded as the course is not commenced.

Best way to approach to Distt. Consumer Redressal Fora. You will get relief. UGC / AICTE rules of refunds are available on internet. dont waste time.

Dear Amit,
You can go ahead in preferring an appeal in proper proforma before the Appellate Authority under RTI Act of the respective university against non-response by PIO within prescribed time frame.
Besides, you have to collect the Rules laid down by your University as regards Refund of Admission fees etc. as well as AICTE/UGC provisions in this regard to make sure you are eligible for refund in the instant situation. This will help you to seek redressal before appropriate legal forum for getting back your legitimate dues if any.

45000 > Tution Fees
5000 > Security Deposit(Refundable)

As per guidelines disclosed above by Mr.Arunagiri if your claim has been made before the start of the session then you are entitled to all of the fees.Make a claim via forum.

I have Withdrawn from the course within one month of commencement of College Session..

Is i am Entitled to get the Refund of my tution fees after a certain deduction ?

If the college had filled all the seats (presume that your seat is also filled, they dont incur any loss just because of your withdrawal), you can try your chance of claiming the tuition fee.

I have Received a Reply to my RTI filled to UGC for Seeking information Regarding
"Refund of College Fees Where a Student surrenders his admission within one month of commencing of college session "

In Reply to my RTI UGC have Provided me with
a copy of "Public notice" & "Letter issued to all demmed university regarding refund of college Fees"


Highlights of the Documents :

"The Entire Fees Collected from the student, after a deduction of the processing fees of not more than Rs.1000/- shall be refunded and returned by the institution deemed to be university to the student withdrawing from the program"

My Query Relating to this is

Q1.Should i send a letter to the College Requesting refund & "Incorporating UGC Guidelines & Document in the letter ??

Q2. Please Provide me with the Specific matter or Statement " To be incorporated in the letter to make it more effective to the college

You can send a letter to the college, mentioning the guidelines and enclosing the RTI reply.

Respected sir,

I have sent a letter to College mentioning the RTI UGC letter received from UGC
But within 15 days i have not received any reply from the college

Should i send a final reminder letter to college ?

Is there a provison that UGC will take action on the college on the complain of student ? Please mention how can i complain to UGC, ?

Pratically, How do you see the possiblity of refund through consumer forums & Estimated time you think procedding shall be completed ?

You can write a complaint to the UGC.

You are having the choice of approaching the consumer forum also.

Both can be concurrently done.

Respected Sir,

I have received a reply from the college
it is mentioned as

"We would like to informs you that the university closed its admission on 31 aug 2011 and no admission was taken after that date, so fees is NOT Refundable"


But i am aware of the facts that admission has been taken place even after the admission date and while i was withdrawing from the college admission has taken place.

I have sent a letter to college on 28 Dec 2011 with RTI Dcoument received from UGC

Now on 02 Jan 2012, i have received a reply from the college. as mentioned above sir.

If you are confident that the college had done admission after the close date and refusing to refund money to you, you can approach the consumer forum.

You need not send any letter to the college, just proceed in filing a consumer case.

The chances of getting the order in favour depends upon the proofs, and presentation of case.
