Dear Experts,
My landlord has purchased a double bed room flat in the year 2007 through bank, bank authorities gas auctioned the property,it is in second floor.The building consisting 4 double bed rooms portions and 4 single room portions.the actual owners resides in ground floor, he was due to bank and bank authorities has auctioned and my land lord purchased and got registered the apartment through bank authorities. In the documents car parking of 100 sft also registered.
Due to some family disputes the builder has handed over the ground floor portion to his daughter who is NRI, she gave the house to rent.
Now the problem is the tenant is not allowing to park my car in the ground floor, he is locking both the gates.yesterday by force I have parked my car in the premises, the land lord from US has complaint to local PS, they came and saw the document and asked me submit the link document,when I Approached P.S, with links document they are asking to file a civil suit and claim my right of car parking.for the entire building there is no provision for car parking but for in front of the Land Lord Staying in US, now what I Have to do to avail parking place as per the document. On whomever shall I file the case, what relief I will get through court.

Yes absolutely by filing a civil suit you can get Car parking space.

Why should you file a civil suit when you are a rightful owner of the parking space as per the documents? You explain the local police that as per the document you are rightful owner and they should support you or keep quiet. You continue occupying the car parking and it is for them to go civil court if they wish to challenge your right. They can not lock the doors of your property.

Ironically, sometimes, even to enforce the legal right to employ muscle power is required. So, if you are muscled enough start to park your car in your entitled space and let them go to court, otherwise you go to the civil court to get declared your right on car parking.
