Regarding 498a need a suggestion

498a was registered on march08 2012,on me my parents and brother.i was arrested and rest got anticipatory bail.chargesheet was filed on january 2013. next hearing is on may 10 2013. my question can i file discharge petition for my brother ? if so in d same court or higher court? what about quash petition? charges are not framed yet.

Petition for discharge is to file in the trial court only.
aLTERNATIVELY YOU CAN FILE PETITION FOR QUASHING.

You can not file discharge for your brother
rather your brother can file for discharge in same court or for a quash u/s 482 in High
Court.
