Regarding complaint against drug inspector

Hello All,

I am from Ujjain-M.P.I need to know as to where I can complaint against the Drug Inspector as he is troubling me for the issue of the drug license for wholesale business. He hasn't asked me for the bribe till yet, but that can be his motive against becoming an obstacle in the initial start of my business.

He is not admitting a valid document ( The possession letter) of possession of the property owned by us given to my father by the mill he has worked in, as a valid document needed to issue a license.

It has been almost 2 months nearly I am wearing down myself by visiting his office and getting a no in reply in a very sweet manner.

I could not start my business because of that, so please can any one guide me over this issue, as to where i can make a complaint or who is the superior who can hear my plight and act upon?

Please also guide me as to what subject category my complaint fits in at this page?

if you have made written application and no action is being taken by drug inspector lodge complaint with his superiors .

Thank you Ajay sir, ur guidance is always helpful. Have experienced it in the past even.

Sir, that's what my question was that where to make a complaint against him? Who is the superior of the Drug Inspector, and whats the best possible chance to get the complaint heard and been act upon in my case?

Secondly, whats the subject category of my query here on this page?

Dear Nadeem Sir,

He has made me run a lot and even after showing him the legal and valid document, he is evading everytime. Though i never wanted to indulge in all this but even dont want him to misuse his authority and even dont want him everyone to be take for granted.

I want to complaint against him not performing his duties.

Non. No. You suspect he is expecting bribe. Be cool. Settle the amount fix the venue and get him trapped. When arrested he will be under suspension and another person will be looking the matter.


Complaint to superior will yield nothing as it will be marked to him for comments as it happens in Govt. He can even get the copy under RTI even if superiors do not give him the complaint.

He is expecting bribe or not sir but as of now he is not performing his duty. thats what i know.. I dont want to spoil his records or services by any means. all i want is the place where i can complaint against him not performing his duties.

Writ of Mandamus lies in the high court against such inaction. However you need to have locus standi to file such case.

Ms. Barman, Thank u for the guidance. Though i had to refer dictionary for some never heard words but after that i guess this is something of great help. But would that be a step to step procedure for me to follow?

means the court can ask me about following the steps of first complaining the superiors and than the sessions court, and so.

Plus I don't have any evidence against him even that he is making me drag my heels.

You need to rush to dictionary. Your advocate knows what is "Writ of Mandamus" as advised by Mr Barman.

If by chance the advocate you meet does not know this then take other one. The court will just be interested to see if you have served any notice/representation to the deptt and the said notice/representation will be basis of your wit.

So you have to engage advocate prior to moving even an inch ahead.

Non-grant and non-rejection of permit despite completion of statutory requirement in itself is an evidence.

How he is harassing you is subjective and it is for your lawyer will see.

Thx for sparing out time and giving me such good advice. As per your guidance its apparent that I need to drag him to the court of law.

Ok, can u please tell me that as Ms Barman said to file a case in high court, so do i need to move to the high court or a lower court can take cognizance of my case?

I wanted first to file complaint against his superiors from where he can be pressurized to fulfill his duties, but again as u've said before it will be of no use as it will be marked for his comments, so i guess the only way left is to move the court.

Ok sir, one more and main question. initially he asked for the possession letter ( given by the Mill by father worked for) of the place from where i want to start my business. That is our hold house and still in our possession. That's the place where the license will be issued.

Now when I produced the possession letter, he askjed for the N.O.C from the mill. I made him remember that he just asked for the possession letter on which he said no I need a NOC even.

Now it is written no where in the brochure/manual of the list given by his office that a NOC is required.

If I give him an affidavit will it suffice the need of an NOC?

My another question What is the importance of an affidavit, and when can it be used?

Even if NOC has not been mentioned in the brouchure, it can be added to the satisfaction of the concerned authorities.

So far importance of the affidavit and the time of its submission is concerned, it is highly vague query which has no boundaries.

Dear Makkad Sir,

It's been last 2 months since I could not even apply for the License as the Drug Inspector first asked only to submit the possession letter of the property at where the license will be issued.

When I shown him the letter he asked for the NOC. I was very enthusiastic to open a new business and did all the hard work for it even, but his constant refusal made me apathetic.

If drug inspector has demanded the NOC then I think there should not be any hurdle thereto. Do complete this requirement and move ahead.

Dear All,

He has absurd demands of the documents i.e giving him the xerox of the registry of the Mill where the house is situated which i want to make as an office.

Now how come someone will give the registry for this thing?
