Regarding court fees

(Querist) 01 January 2014 This query is : Resolved 
U/s 166 of M V Act, if we have paid court fees of maximum limit rs.15,000/- and if the matter is settled or judgement is passed for less amount. How can we get our difference of our court fee?
for example if we have claimed for 15,00,000 the court fee is 15,000 and the matter is settled for 6,00,000 then the court fee will come to 6,000. so the difference is 9,000. can we get that 9,000 back and how?

Dear Querist
if the matter is settle before the court/mediation then due to this settlement 50% of court fee will be refund but if the court pass an judgement then no refund.
it will be better to contact a lawyer personally

Court fee paid is not refundable if the court decree for lesser amount in comparison with the claim.

A refund of 50% of court fee is possible if there is an out of court settlement otherwise, the court fees paid to the court cannot be claimed for the reason that the court ordered a lesser amount.
