Regarding filling up of a vacant general seat in psc exam.

In Madhya Pradesh State Service Exam, a general category candidate is vacating a seat of deputy collector post. So in normal situaiton, this vacancy should be filled from the waiting list by the candidate who has 1st waiting (Lets call him B).
But the already selected OBC candidate ( Lets call him A) in the main merit list has more marks then the candidate who is at 1st waiting position( i.e. A has more marks than B)
So, I want to ask that whether the vacant seat would be filled by the OBC candidate(i.e. A) in the main merit list by reshuffling him to the general category seat or will the seat be filled from waiting list by B irrespective of higher merit of OBC candidate in main merit list

He will fill general vacancy if no concession is availed by him.

@ Dr J C Vashista Sir....Sir I am an OBC candidate and is at 1st waiting in OBC category (5th waiting overall). So if the OBC candidate in main merit list is reshuffled to the general seat, then 1 OBC seat will become vacant and my waiting will clear. That is why I wanted to ask.

@Sudhir Kumar Sir..... No concession has been availed by him at any stage in terms of marks or age.
But when I contacted PSC office regarding this issue, they said the general seat vacancy will be filled from general waiting as per their policy or some software they have for this purpose.
And they were so sure of this rule that they even suggested me to go to court if I have any problem.
So how to challenge this policy and on what grounds.
