Hi,
I lost my phone and other valuables on 04.04.2014, friday. I had reported on the very same day to the near by police station. The moment i informed they about the theft, they started blaming me and they were like its happening always. They asked me to come the next day with a written complaint and also with the photocopy of the bill. i went the next day and they were like they are busy because a "Politician" is visiting their locality and asked me to come on Monday. On Monday they gave me a CSR copy and told me to wait for 15 days to get "non traceable". I tried following up and they were like you have insurance and come after election and they will give non traceable, which clearly means they have not taken any action. I asked them for an FIR copy since the insurance firm has mentioned it for mobiles worth more than Rs.15001/- but they are refusing to give one. The event happened in Tamil Nadu and I am a native of Kerala. I enquired in SP office in Kerala and they said they cant do anything and fir will not be given for mobile theft. The experience was very bitter.
Please help me in understanding what step need to be taken next.

that purely depends on the language of you application as to what can be done.

This is really unfortunate. At least SP should have been cooperative to you.
You can file now case in magistrate's court u/s 156(3) crpc.

I agree with Mr. Devajyoti Barman, file complaint to area SP followed by a criminal complaint u/s 200 read with 156 Cr. PC

The event happened in Tamilnadu and you belong to Kerala. You have contacted SP office at Kerala, since the matter was of Tamilnadu, it is supposed you have reported the matter at Tamilnadu and if it is so how SP office at Kerala can help you?
You can continuously follow the application by sending its copy to SP and IG office.
Moving court under 156(3) Cr.PC would be time and cost consuming, however it is last avenue left if no response received.

My service provider asked me to a file a complaint locally too so that enough measures can be taken. When i called up the officials in Tamil Nadu police station, they are only saying " Come after election, we will give you non traceable, and no FIR will be provided, CSR is enough for insurance". but its clearly mentioned in the insurance form that FIR is needed.

My only question to them was can FIR be provided if its mentioned in the conditions, then they go like, if a mobile is worth Rs.500 or 50000/- its just a mobile. FIR cant be provided for all these silly stuffs.
Quite disappointing.

You have been told to wait for the elections to be over and then you will be given with a non-traceable certificate. The said certificate and CSR will be sufficient for claiming insurance amount for the lost mobile, there is nothing to be so much confused about.

You can make request under the RTI Act for the FIR, if any.
