Regarding Form C

(Querist) 01 May 2011 This query is : Resolved
Form C is issued when we purchase goods from outside the state on concessional rates.i.e @ 1% Or 2%.

Now my Question is.
1. if we are liable to issue c form when we purchase goods outside the state which is located in SEZ or exemption zone who charges no cst in bill. but mentioned on bill that sales is against form C.

2.if we are liable to issue c form for tax free goods purchased from outside the state.

No, when we purchase the exempted goods outside the state, we need not to issue the Form-C. When the seller not charged the cst on bill, again we need not to issue the Form-C.

(1) If the goods are taxable, you will have to issue form c, when demanded by the seller, as if c form s not issued, he can claim tax from your organization any time later, as he is not laiable to pay cst on your behalf, and your organization will have to face audit objection, if tax is paid instead of issue of c form.

(2) For tax-free goods, question of issue of c form does not arise.
