Regarding legal represetative

(Querist) 26 June 2013 This query is : Resolved 
That in the suit of Specific Performance of Contract the defeent dies and the plaintiff had filed an applcication to brought on record the Legal Heirs of that defendant i.e his sisters (because he was unmarried and his mothers and fathers was alredy died)

That his sisters were appeared and filed say on the said application as below

" that noticees have not received any property from the deceased and hence they can't be joined as LR's. the applicant/ noticees are sisters and not legal heirs."

so kindly guide because court fixed the mater for necessary steps

pls guide what steps I have to take wheter I can appoint Received as per O 22 R 4-A

They have merely raised technical objection. Since they have appeared the suit proceed against them.

To hold someone LR,it is not necessary that deceased must have left property to for inheritance of the LR .

Despite objection sister(s) need to be brought on record as they are LRs according to law.
