Regarding promisory note

Hi Sir,

One person known to me has taken money from me signing on Promisory note . He did not filled anything else in the promisory note. He just made the signature.

Now he is not returning me the money and moreover saying that he did not signed on the promisory note.

1) Can you please suggest me what can be done now for this ?

2) Can i approach legally ?

3) if so what are the steps ?

4) if so what are the consequences ?

whether amounts were filled in ? if he has only signed promissroy note if you issue him legal notice he will deny he has signed the note .
you will have to filea summary suit for recovery of the amount mentioned in note

1.how much money advanced?
2.when was it advanced??
3. is the amount advanced accountable???
4.are there witnesses who saw you handing over money????
5.was it a cheque advance,if yes bearer or cash?????
6.is the pro-note/ Promisory note affixed with proper revenue stamp and sign is thereon or on plain part??????

You can very well fillup the amount due and send a legal notice demanding money with interest.

If there is no response, initiate a summary suit.

Blank pronote filed by holder – valid – inchoate instruments – Section 20 enables holder of instrument to fill up the blanks and negotiable instruments which are duly signed by drawer and deliver to holder – promissory note which did not contain writing of drawer but executed by drawee held to be valid. 2002 (2) CTC 140.
