Dear Sir / Madam
Our father has purchased a house through a loan and also cleared it. But after the expiry of my father, their brothers has made a hiba and partitioned the property into 4 parts. out of which one part is ours declared by them. Now when we registered our property we claim for khata change. At that moment we notice that they have applied for an objection. that without their info we cant.
my mother has 3 children one is elder than me and one is younger than me.
But my mother and other two children of hers has given me NOC and i registered on my name
so please help me out as my father brother are criminal minded among them one is lawyer.
so please give me solution by which i can apply for khata change and it should happen.

if father had purchased house it must have been in his name only .
how can his brothers after his demise make a hiba of said house?
only a person who is the owner of property can gift the property

House was purchased and loan was taken / paid by your father. How the property was transferred in the name of your uncles in such case? There seems some gap in the information.
Consult local lawyer and show him all the documents.

Dear Ajay Sir,
We are very much thankful to you for responding and helping us. actually after our father demise, they took us to the court and asked my mother to signing it. where as my mother is illiterate and also in witnesses they took their childrens signature also.But they have not changed the khate (still on my father). Whereas hibba made by them is only notary. But myself made a release deed from my mother brother and sister and registered the property. so what will be hold share on the property of mine. how should i move ahead to prove our uncles (criminals) are guilty.
