SIR,
I MAKE A PROPERTY DOCUMENT ON 100 RS BOND IN 2005 AND MAKE HISAR WHICH WE WRITTEN ALL THINGS WHICH ONE NEEDED. IN THIS HISAR (ON 100 RS BOND) BOTH WE BUYER AND SALER HAVE SIGN ON IT. WE HAD GIVEN HALF PAYMENT TO HIM AND HALF PAYMENT AFTER SIX MONTH AND WE TAKE POSSESSION AND TAKEN ELECTRICITY ON OUR NAME AND PAID THE GRAMPANCHAYAT TAX ON BEHALF ME. BUT AFTER SIX MONTH WE CANNOT GO TO APPROACH HIM NEITHER HE APPROACH US WE DONT APPROACH BECAUSE HE HAVE A LOAN ON THIS PROPERTY WE ALREADY CLEAR BEFORE THAT IF YOU DONT CLEAR LOAN AMOUNT I WILL NOT PAY HALF PAYMENT. WE TRY TO APPROACH HIM BUT HE EVERYTIME CHANGED HIS ROOM SOME OTHER PLACE. AFTER THAT SOMEHOW WE TAKE ADDRESS AND SENT HIM A NOTICE. NOW I AM LIVING HERE SINCE 2005 NEAR ABOUT 10 YRS. NOW HE TOLD TO AGENT THIS IS ON SALE. SIR KINDLY SUGGEST ME WHAT TO DO.

Caveat is an alert application to be filed in advance when you expect the other party may file a legal proceeding against you and can pray interim orders of court against you.

I read the contents that you were given. In that you mentioned that you send a notice to him. Whether you received a reply notice or not. If yes. You should file a civil case against him and get direction from court. If not you should file a caveat and give public notice so that no one will agree to purchase the property

Sir, i received notice from him and in that he denied all claim which we mention and he charge a claim on us that.. in good faith we give you possesion so you give up the possesion.. after that we dont reply him... neither he.. we not cause we were trying to settle matter mutual except civil... thank you ramesh sir..

In my opinion, while you have already filed a caveat petition before the court, you should immediately file a suit for specific performance of contract seeking specific reliefs and getting the sale deed executed through court and also file an injunction application restraining from alienating the property t a third person. This will be best option available before you, please consult a local lawyer and proceed as per his further advise.

BY THAT SENTENCE YOU HAVE BEEN ADVISED TO FILE AN APPLICATION IN COURT TO ORDER YOUR
OPPOSITE PARTY 'NOT TO SALE THE PROPERTY TO ANY THIRD PARTY' AS HE HAS AGREED TO SALE YOU
SO THAT PURPOSE OF YOUR SUIT FOR RELIEF OF SPECIFIC PERFORMANCE MAY NOT GET FRUSTRATED.
