Regarding salary

(Querist) 02 December 2012 This query is : Resolved 
As an expert in the field of law Mr Raj Kumar sir which option will be best and make my case strong

1. Can i will mention the amount in clear terms and pay stamp duty.

or


2.I will file the case with out mentioning the amount.

Please give me expert advise.
Also my total amount is 9 lakhs .What is the rate of stamp duty in Jammu & Kashmir.

It would have been better, had you confined your further query in the same thread.

Anyway, if shall be better not to mention the exact amount and let the opposite party raise objection thereto and if court decides then you shall have to pay, then do it at that stage.

You told me to file the case in lower court under Civil procedure code with consequental relief of granting all service benifets as were undertaken by way of service agreement executed with me.But in the Delhi School Education Act 1973 at Serial No
25 Jurisdition of Civil courts barred - No civil court shall have jurisdiction in respect of any matter in relation to which the Administrator or the Director or any other person authorized by the Administrator or Director or any other officer or authority appointed or specified by or under this Act, is empowered by orunder this Act to exercise any power,and no injunction shall be granted by any civil court in respect of anything which is done or intended to be done or under this Act.
Sir what does this mean to me and my case and what will be its impact on overall case.Hope sir you will reply in good mood.

Though a specific bar of the jurisdiction of court is given in the Act but where the law of natural justice is denied and even their own rules are not followed by those authorities, the jurisdiction of civil courts comes into operation and civil courts in those cases cannot become mere spectators.
